RELOCATION OF A CHILD

    A parent may not relocate a child's residence more than 50 miles of where that child has been living at the time time-sharing was established, or the child's residence was established by the Court.  The parent must have written permission from the other parent, with other requirements the attorney may assist with, or court permission which involves filing a Petition with the Court.  Please read the relocation statute, and do not take any action without seeking advice from a lawyer.

    Temporary absences of 60 days or less do not constitute relocation under most circumstances.
   
    If a relocation is contested by the non-majority parent, the relocating parent must prove certain factors to the Court.  Said factors are contained in Florida Statutes 61.13001.   For more information click on the link to read the statute.
